§ 117.04 LOCATION OF ACTIVITY.
   (A)   No activity requiring a license hereunder may be carried on or conducted if any part thereof is closer than 1,000 feet to the nearest residential real estate or to the boundary line of the real estate on which is located any occupied dwelling house or apartment and no license for an operation so located shall be issued. However, any such activity located within an area bounded on the north by Jackson Boulevard, on the east by Waterfall Drive, on the south by Marion Street, and on the west by Third Street shall not be subjected to the distance restrictions. Also that area bounded on the north by East Jackson Boulevard, on the west by Prairie Street, and on the east and south by the Elkhart River, shall likewise not be subjected to the distance restrictions.
   (B)   If the City Controller receives an application for license for any of the activities set forth in § 117.01 which are to be conducted, managed, maintained, operated, exhibited or carried on in any city park, the Controller shall not issue a license unless the Park Department of the City of Elkhart, through its Director, certifies in writing that the activity for which the license is requested is a part of an official Park Department function, activity or celebration.
