§ 115.28 HEALTH AUTHORITY PERMITS.
   (A)   It shall be unlawful for any person to bring into, send into, or receive into the municipality or its police jurisdiction, for sale, or to have in storage where milk or milk products are sold or served, any milk or milk products defined in §§ 115.25 through 115.30, who does not possess a health authority permit from the Health Officer of the municipality.
   (B)   (1)   Every milk producer, milk hauler, milk distributor and operator of a milk plant shall secure a health authority permit.
      (2)   Only a person who complies with the requirements of §§ 115.25 through 115.30 shall be entitled to receive and retain a health authority permit.
      (3)   Permits shall not be transferable with respect to persons or locations.
   (C)   (1)   A health authority permit may be temporarily suspended by the Health Officer upon violation by the holder of any terms of § 115.27 through 115.30, or for interference with the Health Officer in the performance of his or her duties, or may be revoked after an opportunity for a hearing by the Health Officer upon serious or repeated violations.
      (2)   Any person, firm or corporation shall have the right to take an appeal from any decision of the Health Officer to the Elkhart County Circuit Court, as in other civil cases.
