§ 94.042  BURNING RUBBISH AND TRASH.
   (A)   No person within the city shall burn any rubbish.  No person shall burn trash or leaves at any time within the city limits, except as provided below.
      (1)   Burning shall be in a noncombustible container and may have openings not to exceed 2 inches in diameter on the sides, top and bottom.
      (2)   Burning will only be allowed between the hours of 1:00 p.m. and 6:00 p.m. on Tuesdays, Thursdays and Saturdays.
      (3)   All fires must be completely extinguished so that trash or leaves are not left smoking after 6:00 p.m.
      (4)   All burning must take place on private property at least 15 feet from any building in a noncombustible container.
      (5)   The noncombustible container shall not be set on any street or alley that is brick, blacktop or cement.
      (6)   No burning shall take place on any day designated by the Mayor to be a health hazard day due to adverse atmospheric conditions.
      (7)   Any fire deemed to be an immediate health or fire hazard shall be extinguished immediately on request of a city police officer, health authority or fire authority.  Such a request may be, but is not limited to the result of complaints by nearby residents.
   (B)   (1)   All trash and leaves not burned and rubbish shall be placed in tied disposal bags or containers as provided by §§ 99.01 through 99.10 which shall then be placed for removal by the Street and Sanitation Department on the regular day of trash pick-up.
      (2)   During seasons of unusually large quantities of trash, rubbish or leaves, such as autumn or spring, special pick-up days shall be designated by the Street and Sanitation  Department  and  publicized through  the  local media, and on such dates residents shall be  allowed to place additional disposal bags of trash,  rubbish or leaves at the designated pick-up points.
      (3)   No disposal bags shall be placed at such points for pick-up except within 24 hours prior to the designated pick-up date.
