Eligible for the special exemption. A property owner may obtain a special exemption from the sewer connection requirements contained in § 51.071 for real property located in the designated area if all of the following criteria are met:
(A) Actual use of the real property as of the effective date of this subchapter is residential. Actual use of the property shall be determined by the city's Zoning Administrator;
(B) As of the effective date of this subchapter, the real property is adjacent to a public right-of-way in which there is now located a public sewer; and
(C) The property owner executes a connection agreement consistent with this subchapter.
