(A) A neighborhood that wishes to have a curb and gutter shall petition the Board of Public Works and Safety for a curb and gutter. The petition should include a commitment on the part of the property owners of at least 75% of the frontage on a block to participate. The participation shall be in proportion to their property frontage along the block.
(B) In a block where a majority of the property owners (i.e. 51%) and at least 75% of the frontage want curb and gutter, all properties shall be charged in accordance with § 33.297. If property owners in the minority are unable or unwilling to pay on a voluntary basis, then the City Attorney shall file a lien for the amount plus administrative costs against the property.
