1-7D-3: VILLAGE PROSECUTOR:
   A.   Office Created; Appointment: There is hereby created the office of Village Prosecutor, an executive office of the Village. The Village Prosecutor shall be appointed by the Mayor with the advice and consent of the Board of Trustees. The Village Prosecutor may also hold the position of Village Attorney.
   B.   Duties: It shall be the duty of the Village Prosecutor to assist the Village Attorney by attending all proceedings before the presiding judge of the Third Municipal District of the Circuit Court of Cook County and the Circuit Court of DuPage County as the case may be that involve prosecution for violation of a Village ordinance or State statute wherein the Village is authorized to prosecute and to prosecute such cases on behalf of the Village. He shall advise and assist all Village officers or employees on questions of law involved in filing complaints, making arrests and preparing for prosecution for ordinance violations. He shall also represent the Village in all appeals from decisions rendered by the presiding judge of the District Court in cases involving a prosecution for violation of an ordinance or statute.
   C.   Deputy Village Prosecutor: There is hereby created the offices of Deputy Village Prosecutor. Said officers shall not exceed three (3) in number, shall be under the direction and supervision of the Village Prosecutor and shall have the duties and powers of the Village Prosecutor when so acting. Their compensation shall be determined by the Village Prosecutor but shall not exceed the total compensation paid him, and his compensation shall be lessened to the extent of their compensation.
The Deputy Prosecutor or Prosecutors shall be appointed by the Village Mayor with the approval of the Trustees upon the recommendation of the Village Prosecutor.
