A. The following items are excluded from the price marking requirement contained in section 3-5B-2 of this article:
1. Identical items with a multi-pack package which is properly priced-marked.
2. Single cigars and single packages of cigarettes.
3. Candy, gum and other confectionery items selling for fifteen cents ($0.15) or less per item.
B. The provisions of section 3-5B-2 of this article shall not be applicable to any person utilizing a system of shelf pricing in conjunction with front-end check-out scanning providing said system meets the following requirements:
1. Selling price and size designation of each consumer commodity is stated in a clear and conspicuous manner at the location where each such commodity is displayed for sale in the store.
2. Each sale shall be documented by a receipt given to each purchaser which shall contain a record of the commodities purchased and the selling price of each such commodity.
3. Each system must include a computerized scanning system located at the check-out counter with visual and/or audio notification to the customer of the product cost.
