3-1-16: LICENSE REVIEW COMMISSION; REVOCATION OF LICENSE:
There is hereby established a License Review Commission which shall consist of the Mayor as the License Review Commissioner and two (2) Trustees appointed by the Mayor as subcommission members. It shall be the duty of the subcommission members to assist the Commissioner in the exercise of the powers and the performance of the duties of the Commissioner. Final authority for decisions concerning any licensee issued by the Village shall remain exclusively with the License Review Commissioner.
Upon recommendation of any department responsible for the regulation of licenses, the Village Manager may initiate revocation proceedings as a result of continued violations of this title or for nonpayment of required license fees or charges. The Manager shall notify the License Review Commission of his intent to cause said license to be revoked.
Any such license may be revoked by the License Review Commission at any time during the life of such license for cause provided, however, that no license shall be revoked hereunder until a hearing is held before the License Review Commission. Notice of any hearing must be provided to the licensee at least ten (10) days prior to the date set for such hearing. The License Review Commission shall conduct the hearing and hear all evidence relevant to the request for revocation. The License Review Commission shall render a decision within five (5) days of the License Review Commission finding that the licensee has violated applicable ordinances or statutes relating to its license. In lieu of a revocation, the License Review Commission may suspend the license for a period not to exceed thirty (30) days and/or levy a fine against the licensee in an amount not to exceed five hundred dollars ($500.00).
