No person shall swim, dive or in any way while engaged in swimming activities enter or leave the water of the Pasquotank River and its tributaries from any piece of real estate owned by the city, either in fee simple, as a street right-of-way, as lessee or in which the city has any other proprietary interest; provided, however, nothing herein contained shall prohibit emergency lifesaving or rescue activities.
