1101. PURPOSE.
   (a)   Subdivision regulations are the planning tool used to guide the preparation of land subdivision. Its guiding principles assure the maximum return on local government’s civic interests, and at the same time the subdivision regulations assure the subdivider full consideration of his/her interests and responsibilities. Certain review procedures must be followed to fully understand the objectives of the subdivision regulations and the subdivision process.
   (b)   Whenever the tract to be subdivided is of such unusual size or shape or is surrounded by such development or unusual conditions that the strict application of the requirements contained in these regulations would result in real difficulties or substantial hardship or injustice, the Village Council may vary or modify such requirements so that the subdivider may develop his property in a reasonable manner, but so that, at the same time, the public welfare and interest of the Village and surrounding area are protected and the general intent and spirit of these regulations preserved.
   (c)   Except as exempted by Section 1105.01(35)A., these subdivision regulations shall apply to any division of any parcel of land into two or more parcels or lots, and one of which is less than five acres.
      (1)   A minor subdivision shall be considered to be the division of an original tract of land into five (5) parcels or less, all parcels to front on an existing improved public street and where the transfer of said parcels is to be completed by a metes and bounds description rather than by a subdivision plat.
   A minor subdivision may be approved by the Village Council as provided in Section 3 without the filing of a subdivision plat.
      (2)   A division of land that does not comply with the provisions of Section 1101.01 (c)(1) shall be required to follow all provisions contained in this ordinance. (Ord. 03-05. Passed 6-2-03.)
