921.06 DRILLING WATER WELLS.
   (a)   For the protection of the water supply for the Village and to prevent unnecessary waste of water and the pollution thereof, and in accordance with Ohio R.C. 711.34, any person or entity of whatsoever description, excepting the Village, who drills a well of two inches or more in diameter, or any combination of wells, whereby the combined diameter of such wells exceeds two inches or more, must return to the same earth strata from which it was drawn or forced, the unconsumed portion of such water drawn or forced through these wells. Such water must be returned to the earth without contamination except, however, that by permission of the Village Administrator, a well not to exceed two inches in diameter may be drilled for a residential household use, only, provided:
      (1)   Village water is not available;
      (2)   It is impracticable to extend the Village water mains;
      (3)   The applicant agrees to connect to the Village water mains when such are available, and agrees to pay his proportionate share of the costs of extension of the Village water mains when such extension becomes practical.
   (b)   Whoever violates any provision of this section shall be deemed guilty of a misdemeanor, and upon conviction thereof, shall be fined not more than five hundred dollars ($500.00) for each offense. For the purpose of this section, a separate offense is committed each day water is drawn or forced from the earth and not returned in accordance with this chapter.
