(a) This chapter shall apply to all Persons, including Service Providers, performing work in the Right-of-Way, unless exempted by the terms of Subsection 721.01(c).
(b) The purpose of this chapter is to enable the Village to discharge its duty to protect the public health, safety and welfare by managing reasonable access to, and conserving the limited physical capacity of, the right-of-way.
(c) This chapter shall not apply to any Person or Service Provider that has entered into a written franchise agreement, unless such franchise agreement expressly provides that this Chapter or any part hereof shall nonetheless apply to such person or service provider.
