For purposes of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
APPLICATION. The special event permit application as set forth by the town.
BUSINESS DAY. Any day of the week except Saturday, Sunday, and public holidays. The term BUSINESS DAY includes the term WORKING DAY.
CROWD CONTROL PLAN. A plan that helps visitors move efficiently throughout an event, minimizing confusion and congestion.
HAZARDOUS MATERIAL. Material or liquids that pose a present or future threat to the environment or general public, whether in use, storage, or transit.
MAJOR SPECIAL EVENT. A special event, as defined below, where 500 or more participants are expected in attendance.
PRIVATE PROPERTY. Land or buildings belonging to or restricted for the use or enjoyment of particular persons.
PUBLIC PROPERTY. Land or buildings owned or operated by a governmental or other public agency.
SANCTIONING AUTHORITY. The official administering body that sanctions specific events of the type being requested by the applicant, such as, but not limited to, racing authorities, public sports bodies and event associations.
SPECIAL EVENT. A planned event, happening, or social activity on public or private property where at least 50 individuals are expected to be in attendance, and which is not otherwise under the jurisdiction of another governing authority.
(1) A SPECIAL EVENT may, but is not required to, include any of the following:
(a) The use, sale or display of fireworks;
(b) The sale, purchase, provision or consumption of alcoholic beverages;
(c) The provision of live entertainment;
(d) The provision of overnight activities (e.g., camping);
(e) Motorized or non-motorized vehicular racing or riding;
(f) Activities located wholly or partially on public rights-of-way;
(g) Sports that involve physical contact between participants as part of normal play; and
(h) A film or television production event.
(2) Examples of SPECIAL EVENTS include, but are not limited to, the following:
(a) Filming;
(b) Concerts;
(c) Parades;
(d) Fairs;
(e) Festivals;
(f) Block parties;
(g) Community events;
(h) Mass participation; and
(i) Sporting competitions, such as marathons, running events, and bicycle races.
(3) Activities contained in § 130.67 are specifically excluded from this definition of a SPECIAL EVENT.
SPONSOR. A property owner, person or other entity that undertakes certain responsibilities in connection with some other person or some group or activity, as in being an organizer, promoter, endorser, advisor, underwriter, surety, and the like.
STANDBY SERVICE FEES. Fees charged for standby services provided by police officers, EMS, or the Fire Department station at specific locations, including, but are not limited to, the following:
(1) Standby emergency medical services (EMS);
(2) Standby security/police support, including crowd control and street closure; and
(3) Standby fire services.
