§ 130.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99.
   (B)   If any person shall violate § 130.10, he or she shall be guilty of a misdemeanor and shall be fined an amount as set by the Town Council or imprisoned for not more than 30 days.

   (C)   (1)   (a)   A violation of any provision of § 130.18 shall subject the offender to a civil penalty of up to $100 with a minimum penalty of $15. If the offender fails to pay this penalty within ten days after being cited for a violation, the town may seek to recover the penalty by filing a civil action in the nature of a debt. If the violator of § 130.18(B), (C) or (D) is a person under the age of 18, the parents or legal guardians of the minor shall be subject to the civil penalties referenced herein as if they are the offender.
         (b)   The town may seek to enforce this section through any appropriate equitable action.
         (c)   Each day that a violation continues after the offender has been notified of the violation shall constitute a separate violation and each violation shall be subject to an additional civil penalty.
         (d)   The town may seek to enforce this section by using any one or a combination of the foregoing remedies.
      (2)   In addition to or in lieu of civil penalties or other remedies, each violation of § 130.18(B) or (D) or failure to comply with division (E)(1) shall constitute a separate misdemeanor. Any person convicted of a violation shall be fined not less than $250 for a first offense and $500 for each subsequent offense. In addition to any other remedy, the court shall order any person convicted of a violation to make restitution to the property owner and/or to the town for the damage or loss suffered as a result of the offense. The court may determine the amount, terms and conditions of the restitution.
   (D)   (1)   Any person other than a juvenile charges with violation of §§ 130.50 through 130.54 for the first time shall be given a warning citation. Upon subsequent violation, the person shall be charged with the violation and, if found guilty, the person shall be subject to punishment as provided in G.S. § 14-4.
      (2)   A juvenile who violates any provision of §§ 130.50 through 130.54 is subject to being adjudicated delinquent. The court may, in its discretion, impose any dispositional alternative(s) that are provided in the State Juvenile Code for any juvenile who is delinquent.
