§ 97.08 TREE PROTECTION DURING CONSTRUCTION.
   (A)   Construction plans for public or private property which pose a hazard to existing publicly- owned trees or other plantings must comply with the following protective measures and are subject to approval by the Tree Committee.
   (B)   Changes in grade, trenching, storage of equipment or spillage of chemicals are prohibited within the drip-line of plants located on town property unless specific approval is obtained by the Tree Committee.
   (C)   Location of new driveways across the right-of-way shall be in compliance with § 97.06(D).
   (D)   Publicly-owned trees and other plantings must be protected from soil compaction and mechanical injury during construction by a fence or other similar protective barrier with a dimension of at least 15 feet square with the tree in the center or by a similar suitably sized barrier for shrub plantings. It shall be the responsibility of the person in charge of the construction to provide the protection.
   (E)   If branches are to be pruned from publicly-owned plants to make room for equipment or structures, the pruning must be approved by the Tree Committee and shall be performed by agents of the town or other suitably licensed person or firm (see § 97.11) according to recommended procedures. Cost of approved pruning of publicly-owned plantings for the purpose of private construction, renewal or renovation projects shall be borne by the person in charge of the project.
