§ 92.30 DISPENSERS.
   (A)   Service station.
      (1)   Service stations are buildings and premises where gasoline, oil, grease, batteries, tires and automobile accessories may be supplied and dispensed at retail and where, in addition, the following services may be rendered and sales made, and no other:
         (a)   Sale and servicing of spark plugs, batteries and distributors and distributor parts;
         (b)   Tire servicing and repair, but not recapping or regrooving;
         (c)   Replacement of mufflers and tailpipes, water hoses, fanbelts, brake fluid, light bulbs, fuses, floor mats, seat covers, windshield wipers and wiper blades, grease retainers, wheel bearings, mirrors and the like;
         (d)   Radiator cleaning and flushing;
         (e)   Washing and polishing and sale of automotive washing and polishing materials;
         (f)   Greasing and lubrication;
         (g)   Providing and repairing fuel pumps, oil pumps and lines;
         (h)   Minor servicing and repair of carburetors;
         (i)   Emergency wiring repairs;
         (j)   Adjusting and repairing brakes;
         (k)   Minor motor adjustments not involving removal of the head or crankcase or racing the motor;
         (l)   Sales of cold drinks, packaged foods, tobacco and similar convenience goods for filling station customers, as accessory and incidental to principal operation; and
         (m)   Provision of road maps and other informational material to customers and provision of restroom facilities.
      (2)   Uses permissible at a service station do not include major mechanical and body work, straightening of body parts, painting, welding, storage of automobiles not in operating condition, or other work involving noise, glare, fumes, smoke or other characteristics to an extent greater than normally found in service stations. A service station is not a repair garage nor a body shop.
   (B)   Building requirements. Service stations will strictly meet all setback and building requirements contained in ordinances of the town.
   (C)   Self-service stations.
      (1)   SELF-SERVICE STATION shall mean that portion of property where flammable and combustible liquids used as motor fuels are stored and subsequently dispensed from fixed approved dispensing equipment into the fuel tanks of motor vehicles by persons other than the service station attendant and can include facilities available for sale of other retail products.
      (2)   Approved dispensing devices such as, but not limited to, coin-operated, card-operated and remote controlled types are permitted at self-service stations.
      (3)   All self-service stations shall have at least one attendant on duty while the station is open to the public. The attendant’s primary function shall be to supervise, observe and control the dispensing of Class I liquids while the liquids are actually being dispensed.
      (4)   It shall be the responsibility of the attendant to:
         (a)   Prevent the dispensing of Class I liquids into portable containers not in compliance with the provisions of the Fire Prevention Code;
         (b)   Control sources of ignition; and
         (c)   Immediately handle accidental spills and fire extinguishers if needed.
      (5)   The attendant or supervisor on duty shall be mentally and physically capable of performing the functions and assuming the responsibility prescribed in this section.
      (6)   Emergency controls specified in the applicable provisions of the Fire Prevention Code shall be installed at a location acceptable to the Fire Chief, but controls shall not be more than 100 feet from dispensers.
      (7)   Operating instructions shall be conspicuously posted in the dispensing area.
      (8)   The dispensing area shall at all times be in clear view of the attendant and the placing or allowing of any obstacle to come between the dispensing area and the attendant control area shall be prohibited. The attendant shall at all times be able to communicate with persons in the dispensing area.
      (9)   Hose nozzle valves used at a self-service station for the dispensing of Class I liquids shall be an approved automatic-closing type.
      (10)   Warning signs shall be conspicuously posted in the dispensing area incorporating the following or equivalent wording:
         (a)   “Warning—It is Unlawful and Dangerous to Dispense Gasoline into Unapproved Containers”;
         (b)   “No Smoking”; and
         (c)   “Stop Motor”.
   (D)   Drainage and waste disposal.
      (1)   Provision shall be made in the area where Class I liquids are dispensed to prevent spilled liquids from flowing into the interior of service station buildings. The provision can be by grading driveways, raising door sills or other equally effective means.
      (2)   Crankcase drainings and flammable or combustible liquids shall not be dumped into sewers, streams or adjoining property, but shall be stored in tanks or drums outside any building until removed from the premises.
   (E)   Sources of ignition. In addition to the previous restrictions of this section, the following shall apply. There shall be no smoking or open flames in the areas used for fueling, servicing fuel systems for internal combustion engines, receiving or dispensing of Class I and Class II liquids. Conspicuous and legible signs prohibiting smoking shall be posted within sight of the customer being served. The motors of all equipment being fueled shall be shut off during the fueling operation, except for emergency generators, pumps and the like where continuing operation is essential.
