A. Application For Permit: Any person, firm or corporation desiring to construct, add to, or alter any structure or building within the city (hereinafter for purposes of this Section 8-1-2 “New Structure or Building”) shall make application for a permit for such work to the city council or city building official as appointed by the city council. As a condition of approval and at the applicant’s expense, such application shall be accompanied by:
1. Plans and specifications for the new structure or building as may be required by the city council: These shall include at a minimum floor plans, foundation plans, structural plans, framing plans, and mechanical, electrical, and plumbing plans and a site plan/map;
2. Water modeling results which indicates the new structure or building can be completed in a manner that will provide adequate water supply for domestic water and fire protection and the new structure or building will not adversely affect the city’s ability to continue to provide adequate domestic water and fire protection to the existing water system users; and
3. Sewer service treatment modeling results which indicates the new structure or building can be completed in a manner that will provide adequate sewer service and sewer treatment capacity by the city and the new structure or building will not adversely affect the city’s ability to continue to provide adequate sewer treatment capacity to the existing sewer system users.
B. Issuance Of Permit; Expiration: Upon approval of the application by the city council, the mayor shall issue a permit allowing the applied for construction in accordance with the fee set forth in subsection E of this section. Provided, that the permit issued under the provisions of this section shall expire by limitations and become null and void if the building or work authorized by such permit is not commenced within one hundred twenty (120) days from the day such permit, or if the building or work authorized by such permit is suspended or abandoned, at any time after the work is commenced for a period of one hundred twenty (120) days. Before such work can be recommenced, a new permit shall be first obtained to do so and the fee therefor shall be one-half (1/2) the amount required for a new permit for such work, provided, no changes have been made or will be made in the original plans and modifications for such; and provided further, that such succession or abandonment has not exceeded one year.
C. Extension Of Time: Any permittee holding an unexpired permit may apply for an extension of time within which he may commence work within the time required by this section for good and satisfactory reasons. The city council may extend a time for action by the permittee for a period not exceeding one hundred eighty (180) days upon written request by the permittee showing that circumstances beyond the control of the permittee have prevented action from being taken. No permit shall be extended more than once. In order to renew action on a permit after expiration, the permittee shall pay a new full permit fee.
D. Suspension Or Revocation Of Permit: The city council may, in writing, suspend or revoke a permit issued under the provisions of this chapter whenever the permit is issued in error or on the basis of incorrect information supplied, or in violation of any ordinance of the city.
E. Permit Fees:
1. Fees Enumerated: The applicant for construction, alteration, or addition to any building or structure within the city shall, before their permit is issued, pay a fee which has been agreed upon by the city council by resolution. Building permit fees shall be as follows:
Small storage buildings up to 1,000 square feet = 0.45 per square foot
Example: 20 x 24 = $216.00
Warehouse type building 1,000 square feet and larger = 0.10 per square foot
Example: 5,000 square feet = $1,000.00
Modular homes with foundations = 0.20 per square foot
Example: 24 x 60 = $288.00
Singlewide mobile homes = 0.20 per square foot
Example: 14 x 70 = $196.00
Stick built home = 0.25 per square foot
Example: 40 x 50 = $500.00
Water and sewer connections shall be determined according to individual projects.
2. Permit Fees Reduced: When in the opinion of the city council the construction, alteration, or addition of the project is much lower than or at zero cost of the minimum cost set forth in subsection E1 of this section, then a reduced fee of one-half (1/2) the minimum fee may be set.
F. Penalty: Any person violating the provisions of this section shall be deemed guilty of an infraction, upon conviction thereof, and shall pay a fine of one hundred dollars ($100.00) per offense. (2015 Code; amd. Ord. 1-2018, 1-8-2018; Ord. 1-2023, 2-13-2023)
