A. Voluntary Or Mandatory System: The city council shall officially designate by resolution a garbage collection system as: 1) voluntary; or 2) mandatory. A voluntary garbage collection system shall allow an independent garbage collection firm to solicit services for a fee to residences within the city, or allow residences to haul their own garbage as provided for in section 3-2-4 of this chapter. All independent garbage collection firms who wish to solicit services within the city shall make application to the city council to do so in accordance with section 2-1-10 of this code. A mandatory garbage collection system shall charge a monthly fee for garbage collection and shall designate a city owned or an independent garbage collection firm to collect the garbage on a timely basis and in an equitable manner as determined by resolution under this chapter.
B. Voluntary System; Independent Collection Firm: The current resolution has designated a voluntary system of garbage collection and has designated Western Waste Services, Jerome, Idaho, as an independent garbage collection firm to solicit services within the city. (2015 Code)
