ORDINANCE 07-15
      AN ORDINANCE TO APPROVE AND ADOPT THE
      2007 CODIFIED ORDINANCES AND DECLARE AN
      EMERGENCY
WHEREAS, the City has previously determined that it would be in its best interest to revise and reprint the Codified Ordinances of the City; and,
WHEREAS, the City has heretofore entered into a contract with the Walter H. Drane Company to prepare and publish such recodification; and,
WHEREAS, the recodification of such ordinances together with the new matter to be adopted, the matters to be amended and those to be repealed are before Council.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Eaton, Ohio, that:
Section One. The ordinances of the City of Eaton, Ohio, of a general and permanent nature, as revised, recodified, rearranged and consolidated into component codes, titles chapters and sections within that publication entitled the Codified Ordinances of the City of Eaton, Ohio, 2007, are hereby approved and adopted.
Section Two. The provisions of this Ordinance, including all provisions of the 2007 Codified Ordinances, shall be in full force and effect, as provided in Section 5. All ordinances and resolutions or parts thereof, enacted prior to July 21, 2007 which are in conflict or inconsistent with any provisions of the 2007 Codified Ordinances, are hereby repealed as of the effective date of this Ordinance except follows: The enactment of the 2007 Codified Ordinances shall not be construed to affect a right or liability accrued or incurred under any legislative provision prior to the effective date of such enactment, or an action or proceeding for the enforcement of such right or liability. Such enactment shall not be construed to relieve any person from punishment for an act committed in violation of such legislative provision nor to affect an indictment or act committed in violation of any such legislative provisions, nor to affect an indictment or prosecution thereof. For such purposes, any legislative provision shall continue in full force notwithstanding its repeal for the purposes of revision and recodification.
Section Three. Any section of the 2007 Codified Ordinances without a legislative history at the end thereof indicates that such section contains new matter enacted by this Adopting Ordinance. Such new matter shall be published in summary form as provided under Section 3.04 of the Charter, Attachment A.
Section Four. Through authentication and approval of this Ordinance, the Mayor and Clerk of the Council shall certify that the permanent and general ordinances of the City as codified therein are correctly set forth and constitute the Codified Ordinances for the City of Eaton, Ohio, 2007
Section Five. It is determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council that resulted in such format action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
Section Six. This Ordinance is hereby declared to be an emergency measure for the preservation of the public peace, health and safety of the City and its inhabitants for the reason that there exists an imperative necessity for the earliest publication and distribution for the 2007Codified Ordinances to the officials and residents of the City, so as to facilitate administration, daily operation and avoid practical and legal entanglements, and it shall go into effect immediately upon passage.
