(a) Estimated Value of One Thousand Dollars ($1,000) or Less. Personal property belonging to the City that is not needed for any municipal purpose, the estimated value of which is one thousand dollars ($1,000) or less may be sold by the officer having supervision or management of the property, upon written approval by the City Manager, without advertising for bids.
(b) Estimated Value of More Than One Thousand Dollars ($1,000). Personal property belonging to the City, the estimated value of which is more than one thousand dollars ($1,000), shall be sold pursuant to a resolution passed by Council authorizing such sale, after a determination that such property is no longer needed for any municipal purpose. Council shall indicate in the resolution whether the property shall be sold by bid, in accordance with subsections (c) and (d), or by auction, in accordance with subsection (e), or by internet auction, in accordance with subsection (f) hereof.
(c) Advertising for Bids. The sale of personal property pursuant to subsection (b) hereof shall be by competitive bid, except as otherwise provided herein. Bids shall be taken after advertising for two (2) weeks in a newspaper published in the City.
(d) Consideration of Bids; City’s Rights Reserved. The bids submitted shall be referred to Council and Council shall accept the bid which it considers best. Council shall, after it deems the bid price acceptable, authorize the City Manager to enter into a contract with the highest bidder. In any event, the City shall in all cases reserve the right to reject all bids in the event that any bids submitted are unacceptable.
(e) Auctions. Council may employ an auctioneer to sell personal property under this section.
(f) Internet Auctions. Notwithstanding anything to the contrary in this section, Council may authorize the sale of personal property, regardless of its value, which is not needed for a municipal purpose, or is obsolete or unfit for the use for which it was acquired, by internet auction, in accordance with subsection (D) of Section 721.15 of the Ohio Revised Code.
(g) Personal Property Having No Value. Upon a recommendation by the officer having the management or supervision of personal property that is not needed for public use, or is obsolete or unfit for the use for which it was acquired, and that the property has no value, such property shall be discarded or salvaged upon the approval of the City Manager.
(h) Firearms. No provision of this section shall apply to the disposition and/or sale of firearms. (Ord. 15-04. Passed 5-18-15.)
