921.01 DEFINITIONS.
   As used in this chapter:
   (1)    "B.O.D." (denoting biochemical oxygen demand) means the quantity of oxygen, expressed in milligrams per liter, utilized in five days at twenty degrees Centigrade in the biochemical oxidation of organic matter under standard laboratory procedures, as prescribed in Standard Methods for the Examination of Water and Wastewater, American Water Works Association, Water Pollution Control Federation and American Public Health Association, 13th Edition.
   (2)    "Building drain" means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of the building and conveys it to the building sewer, beginning five feet outside the foundations.
   (3)    "Building sewer" means the extension from the building drain to the public sewer or other place of disposal.
   (4)    "City Manager" means the City Manager as provided for under the Charter of the City or his or her duly authorized agent or representative.
   (5)    "Compatible pollutant" means the biochemical oxygen demand, suspended solids, pH and fecal coliform bacteria, plus additional pollutants identified in the NPDES permit, if the publicly owned treatment works were designed to treat such pollutants and, in fact, do remove such pollutants to a substantial degree.
   (6)    "Consumers" means all customers and users of the public sanitary sewerage system of the City.
   (7)   “Debt service charge” means a charge used to defray costs associated with capital, i.e. principal, interest, coverage and reserves for contingencies (if applicable).
   (8)    "Easement" means a grant by the owner of land to the City for a specified use of land for the installation and maintenance of sanitary sewers for an indefinite period of time or as dedicated for a public right of way.
   (9)    "Finance Director/Treasurer" means the Finance Director/Treasurer of the City as provided for under the Charter of the City or his or her duly authorized agent or representative.
   (10)    "Foundation drains" means subsurface drains laid around the foundation of a building, either within or outside of the building foundation, for the purpose of carrying ground or subsurface water to some point of disposal.
   (11)    "Garbage" means solid wastes from the preparation, cooking and dispensing of food and from the handling, storage and sale of food products.
   (12)    "Health Officer" means the County Health Commissioner or a duly appointed officer of the County charged with appropriate responsibilities and authority.
   (13)    "Incompatible pollutant " means any pollutant which is not a compatible pollutant.

   (13A)   "Indirect discharge" or "discharge" means the introduction of pollutants into a POTW from any nondomestic source regulated under Section 307(b), (c) or (d) of the Act .

   (14)   "Industrial cost recovery charge" means that amount assessed each industrial user to repay that portion of the capital costs of constructing wastewater facilities which is allocable to the treatment of wastes from the industrial user of the wastewater facilities in proportion to the capacity of such facilities committed to its use.

   (15)    "Industrial user" or "user" means a source of indirect discharge.

   (16)    "Industrial wastes" means liquid wastes from industrial processes, as distinct from sanitary sewage, resulting from any commercial, manufacturing or industrial operation or process. "Industrial wastes" does not include solids, sludge or paunch, grease that congeals or becomes solidified or any matter that emits an offensive odor.
   (17)    "Inspector" means a duly appointed representative of the City who is responsible for the enforcement of the specifications and quality of construction.
   (18)    "Maintenance cost" means those costs, including labor, materials, supplies, equipment, accessories and appurtenances, required to maintain the capacity and performance during the service life of the wastewater treatment plant for which such works were designed and constructed.
   (19)    "Major industrial user" means any industrial user of the publicly owned collection and treatment system which has a flow of 50,000 gallons or more per average work day; has a flow greater than five percent of the flow carried by the wastewater collection system receiving the waste; has in its waste a toxic pollutant in amounts as defined in standards issued under Section 307 (a) of PL92-500; or is found by the permit issuance authority in connection with the issuance of an NPDES permit to the publicly owned treatment works receiving the waste to have significant impact, either singly or in combination with other contributing industries, on the treatment works.
   (20)    "Natural outlet" means any outlet into a watercourse, pond, ditch, lake or other body of surface or ground water. (Ord. 80-8. Passed 6-10-80.)
   (21)    "Normal sewage" means sewage which, when analyzed, shows by weight a daily average of not more than 2,085 pounds (250 parts per million) of suspended solids; not more than 1,660 pounds (200 parts per million) of B.O.D .; not more than 834 pounds (100 parts per million) of ether soluble matter (grease and oil); not more than 250 pounds (30 parts per million) of Total Kjeldahl Nitrogen (TKN); and not more than 83 pounds (10 parts per million) of Total Phosphorus (P), each per million gallons of daily flow.

   (22)    "NPDES permit" means the National Pollutant Discharge Elimination System permit as issued by the Ohio Environmental Protection Agency under authorization issued by the U.S. EPA, Region 5, March 11, 1974.
   (23)    "Operating cost" means those costs, including labor, materials, supplies, equipment, accessories and appurtenances, required to operate the wastewater treatment plant at the level of performance required by the NPDES permit .
   (24)    "Permit" means evidence of permission to connect to the sanitary sewerage system.
   (25)    "Person" means any individual, firm, company, association, society, corporation or group.
   (26)    "pH" means the logarithm of the reciprocal of hydrogen ion concentration. The hydrogen ion concentration is the weight of hydrogen ions, expressed in grams per liter of solution.
   (27)    "Properly shredded garbage" means wastes from the preparation, cooking and dispensing of food that have been shredded to such a degree that all particles will be carried under the flow conditions normally prevailing in the public sewer, with no particle greater than one-half inch in any dimension.
   (28)    "Public sewer" means a sewer in which all owners of abutting properties have equal rights and which is controlled by public authority.
   (29)    "Replacement cost" means those costs for obtaining and installing equipment, accessories or appurtenances which are necessary during the service life of the treatment works to maintain the capacity and performance for which such works were designed and constructed. The term "operation and maintenance" includes replacement.
   (30)    "Residence" means a building or house erected or constructed on any lot, parcel of land or premises and used primarily for dwelling purposes, with a lawn adjacent thereto.
   (31)    "Sanitary sewage" means the wastes from water closets, urinals, lavatories, sinks, bathtubs, showers, household laundries, basement floor drains, garage floor drains, bars, soda fountains, cuspidors, refrigerator drips, drinking fountains and stable floor drains.
   (32)    "Sanitary sewer" means a sewer that carries liquid and/or water-carried wastes from residences, commercial buildings, industrial plants and institutions, together with minor quantities of ground, storm and surface waters that are not admitted intentionally.
   (33)    "Service charge" means a user charge plus the debt service charge.
   (34)    "Service Director" means the Director of Service as provided for under the Charter of the City or his or her duly authorized agent or representative.
   (35)    "Sewage" means a combination of water-carried wastes from residences, business buildings, institutions and industrial establishments, together with such ground, surface and storm water as may be present.
   (36)    "Sewer" means a pipe or conduit for carrying sewage.
   (37)    "Sewage works" means all facilities for collecting, pumping, treating and disposing of sewage.
   (38)    "Specifications" means the construction requirements adopted by Council, by resolution, as from time to time amended and modified.
   (39)    "Storm sewer" means a sewer or drain which carries or disposes of storm and surface waters and drainage, but excludes sewage and polluted industrial wastes.
   (40)    "Suspended solids" means solids that either float on the surface of or are suspended in water, sewage or other liquids, and which are removable by laboratory filtering.
   (41)    "Tap-in charge" means the fee charged for the privilege of connecting to the sewerage system. Such charge must be paid in full prior to obtaining sewage service.
   (42)    "Total Kjeldahl Nitrogen (TKN)" means the sum of ammonia nitrogen and organic nitrogen.
   (43)    "Treatment plant" or "sewage treatment plant" means an arrangement of devices and structures used for treating wastewater collected by the sanitary sewerage system.
   (44)    "User charge" means that amount paid by each owner of a structure connected to the treatment works proportionate to the service provided. This charge shall cover all operation, maintenance and replacement costs for the facilities.
   (45)    "User class" means any of the following user classes where the user charge system is applicable:
      A.   Industrial user
       B.   Residential user
      C.   Commercial user
      D.   Governmental user
      E.    Institutional user
   (46)   "Wastewater collection and treatment system" means all facilities for collecting, pumping, treating and disposing of wastewater (sewage).
