No person shall construct, build, establish or maintain upon any public street a driveway from any property abutting such public street to the pavement along such public street, or use any portion of the tree lawn for a private drive, except in compliance with and under the terms of this chapter. However, the provisions of this chapter shall not apply to driveways constructed, built, established or maintained by the City or by persons under contract with the City, unless otherwise stipulated in such contract.
