(a) Creation. The Village Council authorizes the creation of a Reserve Police Unit under the authority of the Municipal Manager. The Reserve Officers shall perform duties, at the direction of the Chief of Police as commanding officer, for purposes of assisting the police force and the Municipality as a whole.
(b) Terms and Powers of the Reserve Police Unit.
(1) Term of service. Reserve Police Officers shall serve so long as the Municipal Manager may direct, or until a resignation submitted by such a member is accepted by the Municipal Manager.
(2) Qualification of members. Members of the Reserve Police Unit need not be residents of the Municipality but must be at least eighteen years of age at the time of their appointment. Such officers are subject to all other requirements enumerated in the rules and regulations provided for in subsection (b)(4) of this section.
(3) Control of unit. The Chief of Police or his designee shall be the commanding officer of the unit and shall have control of the assignment, training, stationing and the direction of work of such unit. Reserve Officers shall have no police powers or arrest authority and are not sworn peace officers. Reserve Officers shall perform only such police duties as are assigned by the Chief or other designated officer in charge and shall act only when wearing the prescribed uniform or portion thereof. Examples of authorized duties include, but are not limited to: traffic direction, crowd control, parade and special event duty, or other duties as assigned by the Chief or his designee. The Chief or other designated officer in charge shall prescribe the time and place such uniform or portion thereof shall be worn. Reserve Officers shall obey the chain of command of the Police Department and shall take orders from any regular appointed members thereof while on assignment.
(4) Rules and regulations. The Chief of Police shall prescribe rules and regulations for the organization, administration, conduct and control of the unit.
(5) Uniforms. The Chief of Police is authorized to prescribe, by the rules and regulations, the type of uniform or part thereof which shall be worn by the members of the unit.
(6) Service on voluntary basis. All services performed by Reserve Police Officers shall be on a voluntary basis.
(7) Nonliability. This section is declared by Council to be an exercise by the Municipality of its police powers for the protection of public peace, health, property, safety and general welfare. Neither the Municipality nor its agent or representative, an officer appointed under this section or any other persons, who in good faith executes an executive order, rule or regulation promulgated pursuant to this section, shall be liable for injury or damage sustained to person or property as the direct or proximate result of such action.
(8) Reserve Officers.
A. Eligibility for the classification of Reserve Officer in the Reserve Police Unit shall be as follows:
1. Minimum service as a Reserve Member;
2. Minimum age eighteen;
3. Meets Police Department physical standards;
4. High school graduate or G.E.D.;
5. Acceptable background investigation;
6. Meets all other requirements of a full-time officer;
7. Pre-employment drug testing; and
8. Approval by the Municipal Manager.
B. The Reserve Officer shall participate in all required reserve police events; shall fulfill all responsibilities required; will attend all intradepartmental training programs; and shall accompany regular police officers on routine patrol as directed by the Chief of Police. All work performed by Reserve Officers is voluntary and shall be performed without compensation. Reserve Officers shall display the dedication, ethics and integrity of a professional police officer; shall be on duty only at the direction of the Chief of Police; and shall have no arrest powers, further operating at all times at the direction of the Chief of Police.
