1460.01 DEFINITIONS.
   Certain words and phrases as used in this Business Maintenance Code are defined for purposes of this Code, as set forth in this chapter.
   (a)   “Approved.” Means approved by the Building Inspector pursuant to this Code, or approved by any other authority designated by City ordinances to give approval to the matter in question.
   (b)   “Board.” The Board of Zoning Appeals.
   (c)   “Basement.” A portion of a building partly or entirely underground whose ceiling or under part of the floor above is four feet or less above the average finished grade.
   (d)   “Building.” Any structure having a roof supported by or suspended from columns or walls which may serve as a shelter or enclosure for persons, animals, chattels or property of any kind. The term "building" does not include any vehicle, trailer whether with or without wheels, nor any moveable device, such as furniture, machinery or equipment.
   (e)   “Business.” All uses or occupancies other than residential.
   (f)   “City.” The City of East Palestine, Ohio.
   (g)   “Code.” This Business Maintenance Code.
   (h)   “Building Inspector.” When used herein shall be construed as the City Manager or representative officially so designated by the City Manager.
   (i)   “Occupant.” The person who leases or rents or otherwise occupies a building, structure or any portion thereof. The words "tenant" and occupant" shall be considered synonymous.
   (j)   “Operator.” A person who has charge, care or control of a business structure.
   (k)   “Owner.” The owner or owners of the premises, including the holder of title thereto subject to contract of purchase, a vendee in possession, a mortgagee or receiver in possession, a lessee or joint lessees of the whole thereof, or an agent or any other person, firm, corporation or fiduciary directly in control of the premises.
   (l)   “Person.” Any person, firm, partnership, association, corporation, company or organization or association of persons of any kind.
   (m)   “Premises.” A lot, parcel or plot of land including the buildings or structures thereon.
   (n)   “Secondary or appurtenant structure and accessory buildings.” A structure, the use of which is incidental or accessory to that of the main building and which is attached to the main building or located on the same premises with it, including retaining walls, fences and exterior walk and steps.
   (o)   “Structure.” Anything constructed or erected, the use of which requires a fixed location on the ground or attached to something having a fixed location on the ground and includes, but is not limited to, advertising signs, fences, billboards, backstops for tennis courts and pergolas.
   (p)   “Supply or supplied.”Paid for, furnished, provided by or under the control of the owner or operator.
