1042.99   PENALTY; NUISANCE; EQUITABLE REMEDIES.
   (a)   Any person who violates or fails to comply with any of the provisions of this chapter is guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00) for each offense. A separate offense is deemed committed each day during or on which a violation or noncompliance occurs or continues. If the offender has been previously convicted of violating or failing to comply with any of the provisions of this chapter, said person is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty days, or both.
   (b)   Any discharge in violation of the substantive provisions of this chapter or an order of the City Manager shall be considered a public nuisance. If any person discharges sewage, industrial wastes or other wastes into the City treatment system contrary to the substantive provisions of this chapter, or any order of the City Manager, the City may commence an action for appropriate legal and/or equitable relief in the Common Pleas Court. The Law Director is hereby authorized and empowered in cases of flagrant, continuing or repeated violations of this chapter to apply to a court of competent jurisdiction for an order enjoining the person from violating this chapter.
