1042.01   DEFINITIONS.
   As used in this chapter:
   (a)   "BOD" (biochemical oxygen demand) shall mean the quantity of oxygen utilized in the biochemical oxidation of organic matter as determined by approved laboratory procedures.
   (b)   "Building drain" shall mean the extension from the building drain to the public sewer or other places of disposal.
   (c)   "City" shall mean the City of East Palestine, Ohio, acting through its duly authorized officials and employees.
   (d)   "Combined sewer" shall mean a sewer intended to receive both wastewater and storm or surface water.
   (e)   "Commercial" shall mean retail or wholesale business establishments that discharge wastewater into the public wastewater treatment system, works and facility.
   (f)   "Foundation drains" shall mean subsurface drains laid around the foundation of a building, either within or outside the building foundation, for the purpose of carrying ground or subsurface water to some point of disposal.
   (g)   "Garbage" shall mean solid wastes from the domestic and commercial preparation, cooking and dispensing of food and the sale of produce.
   (h)   "Industrial" shall include users discharging waste resulting from manufacturing activities involving the mechanical or chemical transformation of materials or substances into other products. These activities occur in establishments usually described as plants, factories or mills and characteristically use power-driven machines and material handling equipment.
   (i)   "Industrial wastes" shall mean waste resulting from manufacturing activities involving the mechanical or chemical transformation of materials or substances into other products.    (j)   "Institutional/governmental" shall mean hospitals, nursing homes or schools, or City, County, State or Federal buildings or facilities, that discharge wastewater into the public wastewater treatment system, works and facility.
   (k)   "May" is permissive; "shall" is mandatory.
   (l)   "Natural outlet" shall mean any outlet, including storm sewers and combined sewer overflows, into a watercourse, pond, ditch, lake or other body of surface or ground water.
   (m)   "Nonsanitary flow" shall mean storm water originating from downspouts, storm and ground water drains and foundation drains.
   (n)   "Normal domestic sewage" shall mean wastewater collected from dwelling units and commercial and institutional buildings. It consists primarily of spent water from a building water supply, to which has been added waste materials from a bathroom, kitchen and laundry.
   (o)   "NPDES (National Pollutant Discharge Elimination System) Permit" shall mean the same as such is defined in the Code of Federal Regulations, 40 CFR Part 125, and in Public Law 92-500, Section 402.
   (p)   "Person" shall mean any individual, firm, company, association, society, corporation or group.
   (q)   "Public sewer" shall mean any sewer owned by the City, including storm, sanitary or combined sewers.
   (r)   "Residential" shall mean a principal family residence or habitation classified as a single-family, multifamily or apartment dwelling that discharges domestic sanitary wastewater having characteristics of 250 milligrams per liter biochemical oxygen demand and 200 milligrams per liter suspended solids into the public wastewater treatment system, works and facility.
   (s)   "Sanitary sewer" shall mean a sewer which carries sanitary or industrial wastes and to which storm, surface and ground water are not intentionally admitted.
   (t)   "Sewage" shall mean the combination of liquid and water-carried wastes from dwellings, commercial buildings, industrial facilities and institutions, together with any ground water, surface water or storm water that may be present, whether treated or untreated, which is discharged or permitted to enter the wastewater treatment system.
   (u)   "Storm sewer" shall mean a pipe or conduit designed for the purpose of carrying storm, surface, cooling and drainage water from the point of origin to some disposal, but which is not intended to carry domestic or industrial sewage.
   (v)   "Suspended solids" (SS) mean solids that either float on the surface of, or are in suspension in, water, sewage or other liquids, and which are removable by laboratory filtering.
   (w)   "Wastewater treatment system" shall mean the structures, equipment and processes required to collect, transport and treat domestic and industrial wastes and dispose of the effluent and accumulated residual solids, and shall be synonymous with "sewerage system".
