246.09   VACATIONS.
   (a)   Policy. It is the policy of the Village of East Palestine to provide annual vacation leave for all full-time employees in full time employment status.
   (b)   Computation of Leave. Full-time employees working a scheduled forty hours or more per week shall earn and be credited with annual vacation leave according to their number of years of continuous service to the Village of East Palestine in the following manner.

Employees with ten or more years of service with the Village may have the option to convert one week or forty hours of vacation for one week or forty hours of salary.
   (c)   The length of service, for computation of vacation, shall be based on the anniversary of the employee's commencement of employment with the Village.
   (d)   Part-Time Employees. Permanent part-time, non-seasonal village employees working thirty two hours, may accrue vacation time on a prorated basis calculated on the number of hours they are regularly scheduled to work on a permanent basis up to only two weeks of equivalent time.
   (e)   Utilization of Leave. Annual vacation leave shall be taken at such time as the department head directs and is subject to his or her administrative discretion. All vacation leave must be requested on a leave request form and approved by the appointing authority and/or his designee prior to taking the time off.
   (f)   Interpretation and Record. A calendar vacation week shall be considered as the amount of time an employee is scheduled to work during a seven-day period. Two calendar vacation weeks shall consist of ten working days.
   (g)   Accumulation. Vacation may be accrued at any level during each year. However, each employee must have his or her accrued time at or below eighty hours for full-time employees and the equivalent of two weeks time accrual for part-time employees at his or her anniversary date. Carryover of vacation leave from year to year, above the allowable accrual level, may be authorized by the Appointing Authority. Any such authorization will not be habitual and will require documented justification by the requesting employee. Under no circumstances is the Appointing Authority required to grant such extension. Should such extension be granted, the time which was carried over should be used as soon as is practicable but no later than sixty days from the beginning of the calendar year.
   (h)   Separation From Service. Upon separation from service, an employee shall be entitled to compensation for any earned but unused vacation leave to his or her credit allowable under the Ohio Revised Code at the time of separation. This does not apply to those employees who have less than one full year of service.
   (i)   Planning of Leave. Vacation must be planned as far in advance as possible so as not to interfere with the efficient operation of the Village. The Appointing Authority shall schedule vacations in accordance with workload requirements and the Appointing Authority reserves the right to deny vacation requests if workload requirements so mandate.
   (j)   Seniority Dates. Seniority for the purpose of calculating vacation is determined according to the total prior service an employee has with the Village of East Palestine for those employees hired on or after July 5, 1987. Seniority for the purpose of calculating vacation for employees hired by the Village of East Palestine prior to July 5, 1987, shall be calculated according to the total prior full-time service with the Village of East Palestine, the state or any other political subdivision hereof. In either case, prior service need not be continuous. An employee who has retired in accordance with the provisions of PERS or any retirement plan offered by the state and who is hired by the Village of East Palestine after July 5, 1987, shall not have his or her prior service with the Village of East Palestine, state or any political subdivision of the state counted for the purpose of computing vacation leave. Vacation accrued for such employee shall be based only upon the service he or she is currently accruing with the Village of East Palestine.
   (k)   Vacation balances will be reported on an employee's paycheck each pay period. It is the responsibility of the employee to check these balances, and to report any problems with them to his or her department head within one month after receipt of his or her paycheck. Failure by the employee to notify of errors in vacation balances on a timely basis will result in no adjustments in the balances.
   (l)   It is the responsibility of the department head to review the management report on vacation balances before approval of vacation requests and to report the employee’s concerns on balances to the Village of East Palestine Personnel Office within one month for review.
   (m)   It is the responsibility of the Village of East Palestine Personnel Office to make any necessary corrections in the vacation balances within one month following notification by the department head, or to notify the employee that the changes are not warranted.
   (n)   Failure by the employee to notify of errors in vacation balances on a timely basis will result in no adjustments in the balances reported.
