Section 3.01   Number and Term.
   The legislative powers of the Municipality, except as otherwise provided by this Charter and by the Constitution of the State of Ohio, shall be vested in a Council of six (6) members, consisting of persons elected from the Municipality at large. All members of the Council shall be elected for overlapping terms of four (4) years, on a non-partisan ballot. At the Municipal general election to be held in November, 1991, six (6) members of Council will be elected. The first, second, and third members with the highest number of votes shall serve a term of four (4) years. The fourth, fifth, and sixth members shall serve for a term of two (2) years.
   At the Municipal general election to be held in November, 1993, the three (3) members receiving the highest number of votes shall serve a term of four (4) years and each four (4) years thereafter. All ties will be decided by lot. Council shall be elected to four-year terms of office. Prior to the Municipal general election to be held in November, 1991, the composition of the Council shall be determined in accordance with the transitional provisions contained in Section 12.02 of this Charter.
   Members of Council shall take office January 1st of the year following their elections and shall serve until the expiration of their terms of office and until their successors are elected and qualified, or appointed and qualified. If for any reason a member of the Council shall fail to qualify for office by January 15th, of the year following his election, a vacancy shall be deemed to exist and such vacancy shall be filled in the manner provided in Section 3.14 of this Charter.
