353.99  PENALTY AND WAIVER.
   (a)   Whoever violates any provisions of this chapter, or aids, abets or assists in the violation of any of such provision, shall, subject to the waiver provisions of subsection (b) hereof, be fined ten dollars ($10.00) for each offense and twenty dollars ($20.00) for each additional offense occurring on the same day.  Subject to the waiver provisions of subsection (b) hereof, a violator relative to a handicap space shall pay fifty dollars ($50.00) for each offense and one hundred dollars ($100.00) for each additional offense occurring on the same day.
   (b)   Each owner or operator may, within seventy-two hours of receipt of notice of illegal parking as provided in Section 353.20, pay the sum of five dollars ($5.00) for the first offense and ten dollars ($10.00) for each additional offense occurring on the same day at the office of the Department of Public Service-Safety in full satisfaction of such violation. For violations of handicapped spaces, the owner or operator may, within seventy hours of receipt of notice of illegal parking as provided in Section 353.20, pay the sum of twenty-five dollars ($25.00) for the first offense and fifty dollars ($50.00) for each additional offense occurring on the same day at the office of the Department of Public Service Safety in full satisfaction of such violation.  The attendant in charge of the department during the time any penalty is paid in satisfaction of any violation shall transmit the proceeds of such collection to the Auditor.  The failure of any owner or operator to make payment as herein required, within the seventy-two hour period, shall subject such owner or operator to the penalty provided in subsection (a) hereof.
