Any individual, firm, association or corporation who violates any of the provisions of this Housing Code, or any order or regulation made by the Housing Inspector herein, for which no other penalty is provided, is guilty of a misdemeanor of the second degree. No person shall be imprisoned for the first offense, and the prosecution shall always be as and for a first offense unless the affidavit upon which the prosecution is instituted contains the allegation that the offense is a second or repeated offense.
