(a) Whoever violates Section 749.09 is guilty of a minor misdemeanor. Each day any violation continues shall constitute a separate offense.
(b) Whoever violates Sections 749.01 through 749.08 is guilty of a misdemeanor of the third degree. Each day that such store or place of business is kept open and such sale conducted without the license required in Section 749.03 or in excess of the period for which such license is issued and for which such license has been paid, shall constitute a separate offense.
