(A) The owner of real estate located in the village and containing houses, buildings, properties used for human occupancy, employment, recreation or other purposes for which an occupancy permit is issued by the village and abutting on any street, alley or right-of-way in which there is now located or may in the future be located any public water main of the village, is hereby required at his or her expense to make a connection to the water facilities of the village in accordance with the provisions of this chapter, within 12 months after date of official notice to do so; provided that, the public water main is within 300 feet of the property line of the real estate.
(B) The owner of any real estate containing a private water source within the village, or within one mile from the village limits, shall cease using the private water source and shall obtain water from the waterworks system of the village provided a water main is within 300 feet of the nearest point of the property line on which the source is located. The village shall notify the owner of any private water source of the requirements of this section, but failure to so notify shall not relieve the owner of the obligation to comply with this section. Upon completion of the connection to the village waterworks system the owner of the private water source shall close up the private source so that it cannot be used as a source of water and will not be a danger to the public or an attractive nuisance. This procedure shall be done in accordance with all rules and regulations of the Kane County Department of Public Health.
