§ 115.117 RELOCATION OR REMOVAL OF FACILITIES.
   Within 30 days following written notice from the village, a license or franchise grantee shall, at its own expense, temporarily or permanently remove, relocate, change or alter the position of any telecommunications facilities within the public ways whenever the corporate authorities shall have determined that the removal, relocation, chance or alteration is reasonably necessary for:
   (A)   The construction, repair, maintenance or installation of any village or other public improvement in or upon the public ways;
   (B)   The operations of the village or other governmental entity in or upon the public ways;
   (C)   The vacation of a public street or the release of a utility easement; and
   (D)   (1)   Abandonment of a facility within the public ways of the village.
      (2)   A facility, will be considered abandoned when it is deactivated, out of service or not used for its intended and authorized purpose for a period of 90 days or longer.
      (3)   A facility will not be considered abandoned if it is temporarily out of service during performance of repairs or if the facility is being replaced.
