§ 115.049 RENEWAL DETERMINATIONS.
   (A)   (1)   Within 90 days, or as extended by the corporate authorities, after receiving a complete application under § 115.048, the corporate authorities shall make a determination granting or denying the renewal application in whole or in part.
      (2)   If the renewal application is denied, the determination shall include the reasons for nonrenewable.
   (B)   The following standards shall apply when determining to grant or deny the application:
      (1)   The financial and technical ability of the applicant;
      (2)   The legal ability of the applicant;
      (3)   The continuing capacity of the public ways to accommodate the applicant’s existing facilities;
      (4)   The applicant’s compliance with the requirements of this chapter and the license agreement;
      (5)   Applicable federal, state and local telecommunications laws, rules and policies; and
      (6)   Other factors as may demonstrate that the continued grant to the licensee the public ways will serve the community interest.
