§ 51.087 PERMIT MODIFICATIONS.
   (A)   The District may modify or amend any wastewater discharge permit issued under this chapter for good cause, including but not limited to the following reasons:
      (1)   To incorporate any new or revised federal, state, or local pretreatment standards or requirements;
      (2)   To address significant alterations or additions to the IU’s operation, processes, or wastewater volume or character since the time of the individual wastewater discharge permit issuance;
      (3)   A change in the POTW that requires either a temporary or permanent reduction or elimination of the authorized discharge;
      (4)   Information indicating that the permitted discharge poses a threat to the District’s POTW, District personnel, or the receiving waters;
      (5)   Violation of any terms or conditions of the individual wastewater discharge permit;
      (6)   Misrepresentations or failure to fully disclose all relevant facts in the wastewater discharge permit application or in any required reporting;
      (7)   Revision of or a grant of variance from Categorical Pretreatment Standards pursuant to 40 C.F.R. § 403.13;
      (8)   To correct typographical or other errors in the individual wastewater discharge permit; or
      (9)   To reflect a transfer of the facility ownership or operation to a new owner or operator where requested in accordance with § 13.13.5.02.6.
   (B)   Within 90 days of the promulgation of a National Categorical Pretreatment Standard, the wastewater discharge permit of each IU subject to said Standard shall be revised to require compliance with said Standard within the time period prescribed by said Standard. All Categorical Pretreatment Standards adopted after the promulgation of this chapter shall be adopted by the District as part of this chapter. Where an IU, subject to a Categorical Pretreatment Standard, has not previously submitted an application for a wastewater discharge permit as required by this chapter, the IU shall apply for a wastewater discharge permit from the District within 180 days after the promulgation of the applicable Categorical Pretreatment Standard by the USEPA. In addition, an IU with an existing wastewater discharge permit shall submit to the District within 180 days after the promulgation of an applicable Categorical Pretreatment Standard, the information required by § 51.086 divisions (B)(6)(h) and (B)(6)(i) of § 51.086.
      (1)   Any changes or new conditions in the permit shall include a reasonable time schedule for compliance.
      (2)   In no case, however, shall said schedule allow for any extension beyond the final date for compliance established for a Categorical Pretreatment Standard.
