(A) All IUs shall complete and file with the District a permit application therefore in the form prescribed by the District. Proposed new IUs shall apply at least 90 days prior to connecting to the POTW.
(B) No discharge permit shall be issued unless and until the following conditions have been met:
(1) The name and address of the facility, including the name of the operator and owner, location of the facility and contact information, description of activities, facilities, and plant production processes on the premises;
(2) Standard Industrial Classification (SIC) number according to the Standard Industrial Classification Manual, Office of Management and Budget, 1987, as amended;
(3) A list of any environmental control permits held by or for the facility.
(4) A brief description of the nature, average rate of production (including each product produced by type, amount, processes, and rate of production), and standard industrial classifications of the operation(s) carried out by such IU. This description should include a schematic process diagram, which indicates points of discharge to the POTW from the regulated processes.
(5) Disclosure of wastewater constituents and characteristics including, but not limited to, those mentioned in this chapter as determined by bona fide chemical and biological analyses. Sampling and analysis shall be performed in accordance with procedures established by the USEPA and contained in 40 C.F.R. Part 136, as amended;
(6) Description of operations including:
(a) Types of wastes generated, and a list of all raw materials and chemicals used or stored at the facility which are, or could accidentally or intentionally be, discharged to the POTW;
(b) Number and type of employees, hours of operation, and propose:
1. Number and type of employees, hours of operation, and proposed or actual hours of operation;
2. Type and amount of raw materials processed (average and maximum per day);
3. Site plans, floor plans, mechanical and plumbing plans, and details to show all sewers, floor drains, and appurtenances by size, location, and elevation, and all points of discharge;
(c) Time and duration of discharges;
(d) The location for monitoring all wastes covered by the permit;
(e) Flow measurement. Information showing the measured average daily and maximum daily flow, in gallons per day, to the POTW from regulated process streams and other streams, as necessary, to allow use of the combined wastestream formula set out in § 2.2C (40 C.F.R. 403.6(e));
(f) Measurement of pollutants.
1. The Categorical Pretreatment Standards applicable to each regulated process and any new categorically regulated processes for existing sources.
2. The results of sampling and analysis identifying the nature and concentration, and/or mass, where required by the Standard or by the District, of regulated pollutants in the discharge from each regulated process.
3. Instantaneous, daily maximum, and long-term average concentrations, or mass, where required, shall be reported.
4. The sample shall be representative of daily operations and shall be analyzed in accordance with procedures set out in this chapter. Where the standard requires compliance with a BMP or pollution prevention alternative, the IU shall submit documentation as required by the District or the applicable standards to determine compliance with the standard.
(g) Disclosure of the nature and concentration of any pollutants or materials prohibited by this chapter in the discharge, together with a statement regarding whether or not compliance is being achieved with this chapter on a consistent basis and, if not, whether additional operation and maintenance activities and/or additional pretreatment is required for the IU to comply with this chapter.
(h) Any other information as may be deemed necessary by the District to evaluate the permit application.
(i) Where additional pretreatment and/or operation and maintenance activities will be required to comply with this chapter, the IU shall provide a declaration of the shortest schedule by which the IU will provide such additional pretreatment and/or implementation of additional operational and maintenance activities.
1. The schedule shall contain milestone dates for the commencement and completion of major events leading to the construction and operation of additional pretreatment required for the IU to comply with the requirements of this chapter including, but not limited to, dates relating to hiring an engineer, hiring other appropriate personnel, completing preliminary plans, completing final plans, executing contract for major components, commencing construction, and all other acts necessary to achieve compliance with this chapter.
2. Under no circumstance shall the District permit a time increment for any single step directed toward compliance which exceeds nine months.
3. Not later than 14 days following each milestone date in the schedule and the final date for compliance, the IU shall submit a progress report to the District, including no less than a statement as to whether or not it complied with the increment of progress represented by that milestone date and, if not, the date on which it expects to comply with this increment of progress, the reason for delay, and the steps being taken by the IU to return the construction to the approved schedule. In no event shall more than nine months elapse between such progress reports to the District.
(j) 1. All wastewater discharge permit applications, IU reports, and certification statements must be signed by an authorized representative of the IU and contain the certification statement in § 51.120.
2. If the designation of an authorized representative is no longer accurate because a different individual or position has responsibility for the overall operation of the facility or overall responsibility for environmental matters for the company, a new written authorization satisfying the requirements of this section must be submitted to the District prior to or together with any reports to be signed by an authorized representative.
