§ 132.022 CERTIFICATION OF CONTENTS.
   (A)   The provisions of §§ 132.020 and 132.021 notwithstanding, no retailer selling, displaying, offering for sale, distributing, lending, giving away, or otherwise making available to any person any horror comic book, crime comic book, sexually indecent comic book, or comic book portraying deeds of brutality and violence, as defined in § 132.020, shall be held in violation of this code if, prior to the sale, display, offering for sale, distributing, lending, giving away, or otherwise making available to a person, the retailer has obtained from a wholesaler or distributor, licensed as such to do business in the city, a written certification that the particular comic book supplied to the retailer is not of the nature defined in § 132.020. The certification shall plainly and legibly show the date of delivery to the retailer and the name and local address of the party signing certification.
   (B)   If any wholesaler or distributor or any agent or representative thereof shall falsely certify to a retailer that any comic book supplied by him or her to a retailer is not a horror comic book, crime comic book, sexually indecent comic book, or comic book portraying deeds of brutality and violence, as defined in § 132.020, the wholesaler or distributor and his or her agent or representative shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished or fined as provided in § 132.999.
