A. The purpose of this article is to provide for the health, safety and welfare of people of the city of Duncan (city) by the regulation of nonstormwater discharges to the city's municipal separate storm sewer system (MS4). This article sets forth uniform requirements to regulate the direct or indirect introduction of pollutants into the MS4 in order for the city to comply with all applicable state and federal laws including the national pollutant discharge elimination system (NPDES) stormwater regulations (40 CFR part 122), and the Oklahoma pollution discharge elimination system ("OPDES"), (OAC:252-606-1-1).
B. The objectives of this article are to:
1. Control the direct or indirect introduction of pollutants into the MS4 by stormwater discharges from any source or user;
2. Control the introduction into the MS4 of any spills, dumped or disposed material other than stormwater;
3. Prohibit illicit connections and illegal discharges to MS4;
4. Establish legal authority for inspection, surveillance and monitoring of the MS4 to ensure compliance and identify noncompliance with this article. (Ord. 1745, 11-10-2015)
