A. Approval of participation in an excess capacity facility shall be by contract between the city/authority and the applicant. This contract shall prescribe, at a minimum:
1. The basis and extent of city/authority participation in the construction of the facility;
2. The applicant shall secure the design of the sanitary sewer extension in accordance with local and state requirements;
3. Participation is subject to submission and approval of plans, specifications and bid documents by the city/authority and the Oklahoma state department of health;
4. The applicant shall secure all easements and permits necessary for construction of the facility in the name of the city;
5. Construction contracts shall be awarded by the city/authority in accordance with applicable competitive bidding provisions of state statutes, unless otherwise agreed in accordance with section 12-908 of this chapter; and
6. Notice to proceed with construction will not be issued prior to deposit with the city/authority of the applicant's portion of construction costs. (Ord. 1354, 8-9-1994)
