If starlings or similar birds are found to be congregating in such numbers in a particular locality that they constitute a nuisance or a menace to health or property, the property owner or tenant may apply for a city permit to utilize commercially available audio or visual measures to discourage birds from roosting. The permit must be approved by the Chief of Police or his or her designee prior to any discouragement techniques being implemented if such measures could be annoying to neighbors. The property owner or tenant is responsible for any costs associated with any attempts to discourage the birds from congregating.
