12-423: FINAL PLAT:
   A.   Following approval of the preliminary plat, the subdivider shall file an application for final plat approval. The application shall:
      1.   Be made on forms available at the office of the administrative officer of the planning commission;
      2.   Comply in all respects with the preliminary plat as approved by the planning commission; and
      3.   Be accompanied by a minimum of four (4) paper copies and one original cloth tracing or reproduction mylar of the final plat as described in these regulations.
   B.   Upon receipt of a final plat, the administrative officer shall:
      1.   Set a date for planning commissioner review of the final plat; and
      2.   Review the final plat for conformance with planning commission approval of the preliminary plat and prepare a report and recommendations for the planning commission.
   C.   The planning commission shall, within forty five (45) days of the official submission date, approve, modify and approve, or disapprove the subdivision application by resolution which shall set forth any conditions to which the approval is subject, or reasons for disapproval. In the resolution, the planning commission shall stipulate the period of time when the performance bond shall be filed or the required improvements installed, whichever is applicable. In no event shall a performance bond be submitted later than six (6) months from the date of the final resolution. In no case shall the period of time for the completion of improvements exceed two (2) years from the date of the final resolution.
   D.   Upon approval of the final plat by the planning commission, it shall be submitted to the governing body for approval and acceptance of public ways and service and utility easements and land dedicated to public use. This approval of the plat shall be shown over the signature of the mayor/chairman and attested to by the city/county clerk. The acceptance of dedications, as evidenced by the signature of the mayor/chairman shall not be executed prior to the subdivider's compliance of the provisions of these regulations.
