12-414: DEFINITIONS:
For the purpose of these regulations, certain terms used herein are defined as follows:
ADMINISTRATIVE OFFICER OF THE PLANNING COMMISSION: The officer as appointed by the governing bodies to administer these regulations and to assist the planning commission and other boards and commissions. If no such officer shall be appointed, the building inspector shall serve as administrative officer.
ALLEY: A minor right of way dedicated to public use, which gives a secondary means of vehicular access to the back or side of properties otherwise abutting a street, and which may be used for public utility purposes.
APPLICANT: The owner of the land proposed to be subdivided or his representative. Consent shall be required from the legal owner of the premises.
BLOCK: A parcel of land intended to be used for urban purposes, which is entirely surrounded by public streets, highways, railroad rights of way, public walks, parks, or green strips, rural land or drainage channels, or a combination thereof.
BOARD: The board of county commissioners of the county.
BOND: Any form of security including a cash deposit, surety bond, collateral, property, or instrument of credit in an amount and form satisfactory to the governing body. All bonds shall be approved by the governing body wherever a bond is required by these regulations.
BUILDING LINE OR SETBACK LINE: A line or lines designating the area outside of which buildings may not be erected.
DEVELOPER: The owner of land proposed to be subdivided or his representative. Consent shall be required from the legal owner of the premises.
EASEMENT: The authorization or grant by a property owner for the use by another, of a designated portion of the owner's property for a specified purpose or purposes. An easement may be used by the owner of the property provided such use does not conflict with the use of the easement for its intended purpose.
EASEMENT, DRAINAGE: A grant of a right to discharge surface waters over or across a portion of land. A drainage easement may not be obstructed, filled, or otherwise altered in such a manner as to reduce its usefulness for its intended purpose.
EASEMENT, PUBLIC: A grant to a public body of an easement as distinguished from a grant to a private corporation or individual. In example, a public utility easement which is granted to a municipal corporation which may be used by any authorized utility as compared to an easement granted solely to a specified utility corporation.
EASEMENT, RESERVE ACCESS: A grant of a right to prohibit access facilities, usually private driveways, from one property to another or to a public right of way.
EASEMENT, UTILITY: A grant of a right to install and maintain utility systems under, over and upon a designated portion of a property.
GENERAL PLAN: The comprehensive development plan for the metropolitan area which has been officially adopted to provide long range development policies for the area subject to urbanization in the foreseeable future and which includes, among other things, a plan for land use, land subdivision, circulation and community facilities.
GOVERNING BODY: Shall refer to the city council of the city or the board of county commissioner of the county.
LOT: A subdivision of a block or other parcel intended as a unit for the transfer of ownership or for development.
LOT, CORNER: A lot located at the intersection of and abutting on two (2) or more streets.
LOT, DOUBLE FRONTAGE: A lot which runs through a block from street to street and which has two (2) nonintersecting sides abutting on two (2) or more streets.
LOT, REVERSE FRONTAGE: A double frontage lot which is to be developed with the rear yard abutting a major street and with the primary means of ingress and egress provided on a minor street.
PLANNING COMMISSION: The planning commission of the city of Duncan, Oklahoma.
PLAT, FINAL: A map of land subdivision prepared in a form suitable for filing of record, as described in these regulations with necessary affidavits, dedications and acceptances; and with complete bearings and dimensions of all lines defining lots and blocks, streets and alleys, public areas and other dimensions of land.
PLAT, PRELIMINARY: The preliminary drawing or drawings described in these regulations indicating the proposed manner or layout of the subdivision to be submitted to the planning commission for approval.
PLAT, SKETCH: A sketch preparatory to the preparation of a preliminary plat to enable the subdivider to save time and expense in reaching general agreement in the planning commission as to form of the plat and objectives of these regulations.
RIGHT OF WAY: A strip of land occupied or intended to be occupied by street, crosswalk, railroad, road, electric transmission line, or oil or gas pipeline, water main, sanitary or storm sewer main, or for other special use. The usage of the term "right of way" for land platting purposes shall mean that every right of way hereinafter established and shown on the final plat is to be separate and distinct from the lots or parcels adjoining such right of way and not included within the dimensions or areas of such lots or parcels. Right of way intended for streets, crosswalks, water mains, sanitary sewers, storm drains, or any other use involving maintenance by a public agency shall be dedicated to public use by the maker of the plat which such right of way is established.
SAME OWNERSHIP: Ownership by the same person, corporation, firm, entity, partnership, or unincorporated association or ownership by different corporations, firms, partnerships, entities, or unincorporated associations, in which a stockholder, partner, or associate, or a member of his family owns an interest in each corporation, firm, partnership, entity, or unincorporated association.
STREET: Any public or private right of way which affords the primary means of access to abutting property.
STREET, COLLECTOR: A minor street which collects traffic from other minor streets and serves as the most direct route to a major street or a community facility.
STREET, CUL-DE-SAC: A local street with only one outlet and having an appropriate terminal for the safe and convenient reversal of traffic movement.
STREET, FRONTAGE OR SERVICE: A minor street auxiliary to and located on the side of a major street for service to abutting properties and adjacent areas and for control of access.
STREET, MAJOR: An arterial street which is designated on the major street plan.
STREET, MINOR: A street whose primary purpose is to provide access to adjacent properties and which is designed so that its use by arterial traffic will be discouraged.
SUBDIVIDER: Any person who:
   A.   Having an interest in land causes it, indirectly or directly, to be divided into a subdivision;
   B.   Directly or indirectly sells, leases or develops, or offers to sell, lease, or develop or advertises for sale, lease, or development any interest, lot, parcel site, unit or plat in a subdivision;
   C.   Engages directly or through an agent in the business of selling, leasing, developing, or offering for sale, lease, or development a subdivision or any interest, lot, parcel site, unit, or plat in a subdivision; and
   D.   Is directly or indirectly controlled by, or under direct, or indirect common control with any of the foregoing.
SUBDIVISION: The division or redivision of land into two (2) or more lots, tracts, sites or parcels for the purpose of transfer of ownership or development for the dedication or vacation of a public or private right of way or easement. (Res. 901, 5-10-1977; amd. 2015 Code)
