(a) If there are two or more family units or two or more business units, or a combination of both, in a single structure on a single lot, whether residential or commercial, then it shall be unlawful for the occupants of the aforesaid structure or structures to dispose of garbage or trash unless there is an approved enclosure constructed to accommodate garbage or trash containers in order to keep animals from destroying such garbage or trash.
(b) Any person violating any of the provisions of this section, or failing or refusing to abide with the rules and regulations promulgated to effectuate any provisions of this ordinance, shall, upon conviction, be fined not less than fifty dollars ($50.00) nor more than two hundred and fifty dollars ($250.00) and costs. In addition, if any persons fail to comply with this section, the City authorities may, after three days notice to the owners or occupants or their agents, have such trash and rubbish removed and shall be permitted to construct the enclosures set forth in the section and shall charge the expense thereof to such persons, and such charge shall be a lien upon the property of the owner or occupant, and may be collected in the same manner as taxes are collected under the Charter and the general laws of this State.
