351.10 DRIVING UNDER SUSPENSION OR REVOCATION.
   Any person who drives a motor vehicle on any public highway of this Municipality at a time when his or her privilege to do so has been lawfully suspended or revoked by the State of West Virginia or any other jurisdiction is, for the first offense, guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00); for the second offense, the person is guilty of a misdemeanor and, upon conviction thereof, shall be fined not less than one hundred dollars ($1 00.00) nor more than five hundred dollars ($500.00); for the third or any subsequent offense, the person is guilty of a misdemeanor, and, upon conviction thereof, shall be confined in the county or regional jail for a period of not more than thirty days and shall be fined not less than one hundred and fifty dollars ($150.00) nor more than five hundred dollars ($500.00).
