When the defendant in any case is to be tried under the provisions of the Codified Ordinances the right to a continuance shall lie within the discretion of court, however, when the Municipal Judge is sitting in the capacity as a magistrate, either party shall be entitled to a continuance of the cause for seven days. Every continuance on the application of a party shall be at his cost, except where the continuance is a matter of right as set forth herein.
