Definitions. As used in this Article:
(a) County Clerk shall mean the Clerk of the County Commission of Kanawha County, West Virginia.
(b) City Building Inspector shall mean the person who is employed by the City of Dunbar and designated as the City's Building Inspector, or his or her designee.
(c) Dwelling shall mean any buildings, structures or improvements located on a Property, whether or not intended, or actually utilized, for human habitation.
(d) Ex-Officio Members shall mean the Chief of the City's Fire Department and the City's ranking health officer.
(e) Member(s) shall mean the Mayor, the Building Inspector when serving in his or her capacity as a member of the Property Board and the at-large member of the Property Board appointed by the Mayor. Members shall not include any ex-officio members of the Property Board.
(f) Notice Address shall mean the address maintained by the Assessor of Kanawha County in connection with the ad valorem tax tickets assigned to a Property.
(g) Person shall mean a human being or a firm, trust, corporation, association, partnership, limited liability company, limited partnership, public entity or other legal entity of any other kind or character.
(h) Present Occupant shall mean the Person(s) who reasonably believed to be presently occupying a Property or Dwelling, whether or not such Person has a legal right to do so and whether or not that Person is in fact presently occupying the Property or Dwelling.
(i) Property shall mean any parcel of real property or any right or interest in real property that is identifiable of record with the County Clerk.
(j) Property Articles shall mean this Article and any other Articles, Sections, Subsections, paragraphs or otherwise of the Codified Ordinances of the City of Dunbar or any ordinances adopted by the City Council thereof, that the Property Board has been authorized by the City Council to enforce pursuant to the terms of this Article.
(k) Property Owner shall mean that Person assessed as the owner of a Property by the Assessor of Kanawha County, West Virginia.
(l) State Law shall mean the West Virginia Code of 1931, as amended, and any lawfully enacted or promulgated regulations or legislative rules of the State of West Virginia along with all common law of the State of West Virginia.
