(a) Dunbar City Council has the authority to order the demolition of any property or structure that has been deemed a public health or safety hazard because of any natural disaster, fire damage, flood damage, lack of maintenance or any other violation that would result in the condemnation of the structure pursuant to the International Property Maintenance Code, then in effect, as adopted.
(b) The Building Code Official shall order the condemnation, or if the structure is fire damaged, both the Building Code Official and the Fire Chief shall inspect the structure and make the necessary recommendation.
(c) A written report shall be present to City Council explaining the justification for the demolition request.
(d) The property owner shall be notified at least fourteen (14) days prior to the Council vote and afforded the opportunity to present their case against the demolition. If City Council votes in the affirmative for the demolition, the property owner shall have twenty (20) days to file a written appeal to Kanawha County Circuit Court for injunctive relief from the demolition.
(e) Notification process shall follow the rules of West Virginia Civil Process Law. The notification shall be certified first class mail to the owners last known address. If the mail is return as undeliverable, notice shall be placed in a conspicuous location on the property.
