129.04 DUNBAR RESERVE UNIT/COMMUNITY PATROL.
   (a)   Organization.
      (1)   The Reserve Unit is an organizational unit under the jurisdiction of the Police Department. A regular sworn police officer shall be assigned as coordinator of the Reserve Unit. He shall be assigned by the Chief of Police.
      (2)   The Reserve Unit shall be set up as follows:
         A.   The Chief of the Reserve Unit/Community Patrol shall be appointed by the Mayor and Chief of Police.
         B.   The Reserve Captain shall be appointed by the Reserve Coordinator and Chief.
         C.   The Reserve Lieutenant shall be appointed by the Reserve Coordinator and Chief.
         D.   There shall be up to 3 sergeants selected by a point system devised within the organization for activities worked.
         E.   There shall be a complement of no more than twenty-five Reserve members divided into the following squads:
            1.   Headquarters squad made up of a Chief, Captain and Lieutenant.
            2.   Each of the remaining squads shall be made up of one Sergeant and five patrol members.
            3.   The Reserve Chief shall be responsible for carrying out such orders as issued by the Coordinator as may be necessary for the efficient operation of his unit and members under his supervision.
            4.   The Reserve Captain shall be responsible for maintaining complete records of this unit, making frequent reports to the Reserve Chief and/or the Coordinator as designated or requested.
            5.   The Reserve Lieutenant shall endeavor to fill all requests for details, special or otherwise. He shall keep in close contact with members under his supervision, noting carefully any change in address, telephone number and availability of Reserve members during the twenty-four hours of each day.
            6.   Each squad of the Reserve Unit shall be under the supervision of a Reserve Sergeant who shall acquaint himself with all members within the Squad and shall maintain a listing of names, telephone numbers, addresses and availability of squad members for all requests for assistance and emergencies.
   (b)   Powers and Duties of Coordinator.
      (1)   The Coordinator of the Reserve Unit shall be responsible for the execution of all orders and rules governing the Reserves. The Coordinator shall have the power to enforce all orders, written or verbal, issued by the Chief of Police or Mayor. In addition, he shall have control of all property of the City that may be assigned to the Reserve Unit.
      (2)   The Coordinator shall have control, management and direction over all members of the Reserve Unit with authority to detail any member to such service as may be necessary, together with power to remove, discharge, suspend, or reduce in rank any member for insubordination or dereliction of duty, and in no event shall the Coordinator take such action until the member has been furnished with a written statement of the reason for such action. Members shall have the right of appeal to the Reserve staff, finally, to the Chief of Police and/or Mayor.
      (3)   All applicants shall have a background check done by the Police Department.
   (c)   Purpose of the Unit; Control by Police Department.
      (1)   The Reserve Unit shall be maintained for the purpose of assisting without compensation regularly appointed police officers in preserving law and order within the City.
      (2)   The Reserve Unit shall function only upon the request of the Police Department and only under the control of the Police Department. The rank and authority of individual Reserve members pertain only to the Reserve. A Reserve member has no jurisdiction over any regular police officer regardless of rank or title, and when on duty shall be subordinate to the regular police officer.
   (d)   Powers and Duties of Unit.
      (1)   The Reserve Unit shall render volunteer service upon occasions when in the opinion of the Reserve Coordinator, with approval of the Chief of Police or Mayor, such augmentation of the regular department is essential to the public welfare and safety.

      (2)   The Reserve Police Unit shall be used for traffic control during parades, sporting events, handling crowds at rallies, fairs, and all other events as determined by the Coordinator and the Chief of Reserves. The Reserve Police Unit shall also perform such duties as routine police patrol, police telephone and/or radio communications, and to include the issuance of parking violation citations, and may engage in such investigation activity as so directed by the Mayor and/or the Chief of Police, such duties and activities, however, to be performed in such a manner as not to interfere with any regular police work to reduce the manpower of the regular Police Department.    The Reserve Unit shall be permitted to operate a City vehicle and may be permitted to accompany a regular police officer in the police cruiser, if circumstances permit it.
The duties hereinabove set forth are not, however, in any way to be construed as vesting the Dunbar Reserves with general police powers as are vested in regular members of the Dunbar Police Department.
   (e)   Uniforms and Equipment.
      (1)   When providing an authorized service, every Reserve officer must be in complete uniform as specified for Reserve members. Uniforms issued by the City shall remain the property of the City.
      (2)   A Reserve Unit insignia or patch shall be worn on the outside garment.
      (3)   The regulation Reserve badge shall be worn on the left breast of the outside garment.
   The equipment issued to Reserve Police members may consist of the usual equipment issued to regular police officers, except said Reserve officers shall not be permitted to carry any firearm or any other equipment deemed to be dangerous and deadly under the laws of the State of West Virginia.
   (f)   Rules and Regulations.
      (1)   The Manual of Rules and Regulations promulgated and prescribed by the Reserve Unit and Police Coordinator shall be applicable to all members of the Reserve Unit. A Reserve member may be suspended or dismissed for violation of such rules of conduct or rules and regulations.
      (2)   The appointment and continuance of the Reserve Unit of the various members of the Reserve shall depend upon their ability and willingness to attend all calls of duty, scheduled training, and compliance with the Manual of Rules and Regulations.
