§ 30.06 USE OF THE OFFICIAL TOWN SEAL.
   (A)   Official town seal.
      (1)   The official town seal, as adopted on December 4, 2013, is as follows:
      (2)   The town seal is a registered trademark with the state and is subject to all protections afforded by this designation.
      (3)   The town seal may be depicted in color or black and white.
   (B)   Authorized uses of the town seal.
      (1)   The Town Clerk shall be the official custodian of the town seal. It shall be the duty of the Town Clerk to keep in some secure place the seal and affix the seal to whatever papers the Town Council shall direct and as required by law.
      (2)   Authorized town officials and employees may use the town seal for purposes approved by the Town Council. Use of the town seal is restricted to official town business and may not be used by private companies, organizations, or individuals. The town seal is authorized for use by the Town Council in association with the following:
         (a)   Town vehicles and other property;
         (b)   Town signage;
         (c)   the town website,
         (d)   Town communications and announcements, which must be individually approved by the Town Manager or his or her designee;
         (e)   Promotional items and memorabilia;
         (f)   Clothing for the Town Council, town staff, and boards, commissions, and volunteers as approved by the Town Manager.
      (3)   The Town Manager may approve the use of the town seal for purposes not listed above, provided that such use is related to official town business.
   (C)   Manufacture and sale of souvenirs and decorative items. Any person may, subject to the requirements in this section, manufacture or sell objects, such as souvenirs or decorative items bearing the town seal as part of the design. Use of the town seal under this section must be approved by the Town Council and may occur only under a written agreement with the town, approved by the Town Council or its designee, containing such requirements and limitations as the Town Council or its designee shall deem appropriate to assure that such use of the town seal is in the best interests of the town.
   (D)   Prohibited uses.
      (1)   No person may attach, impress, or display the town seal, or any representation thereof, except as authorized in division (A) of this section.
      (2)   No person may use the town seal, or any representation thereof, for purposes of supporting or opposing the nomination or election to any town or other public office of any person, or for purposes of supporting or opposing any ballot measure, or on any materials distributed for purposes of influencing the actions of the voters in any election.
      (3)   No person may use the town seal, or any representation thereof, for the purpose of conveying, or in a manner reasonably likely to convey, an impression of sponsorship or approval by the town.
   (E)   Violation.   Violation of this section shall result in a civil penalty pursuant to § 10.99.
