§ 151.56 PERMIT FOR DEMOLITION; PROCEDURE; APPEAL.
   (A)   Permit required.
      (1)   No person shall demolish any building or part of any building, structure or dwelling within the corporate limits of the town without first applying for and obtaining a permit from the Building Inspector.
      (2)   Prior to the issuance of a building permit, the owner or applicant shall pay all appropriate fees and bonds in accordance with the consolidated fee schedule of the town.
      (3)   Septic tanks, drain lines, or pilings shall not be removed from the site without specific authorization from the Building Inspector.
      (4)   No permit shall be issued for commercial property demolition, or demolition of residential properties that were at any time used for commercial purposes, without submission of an asbestos report.
   (B)   Procedure for demolition from a location within an ocean hazard or an estuarine AEC:
      (1)   Obtain a CAMA permit, if required;
      (2)   At a minimum, the following building permit provisions shall apply:
         (a)   All pilings and portions of pilings shall be removed from the ground and the site in their entirety;
         (b)   All glass doors, windows and the like and all broken glass shall be removed and disposed of appropriately prior to demolition;
         (c)   All electrical, cable, telephone and water service pipes and lines shall be removed to the point of their service connections;
         (d)   All septic tanks, drain lines and service lines shall be removed from the site in their entirety;
         (e)   Unless permitted by CAMA, all concrete/asphalt within the ocean hazard AEC shall be removed;
         (f)   All sand bags shall be removed from the site; and
         (g)   All debris shall be disposed of utilizing approved disposal sites.
      (3)   To ensure compliance with this subchapter, the town code and the building permit, the holder of the building permit shall contact and receive approval from the Building Inspector prior to proceeding with the following schedule. Failure to call for any required inspection(s) shall result in the assessment of a fee as set forth in the consolidated fee schedule of the town. All septic tanks, drain lines and pilings shall not be removed from the site without specific authorization from the Building Inspector. After the issuance of a building permit for the demolition of a structure, the following minimum procedures shall be followed:
         (a)   The applicant shall contact the Dare County Department of Environmental Health to locate on-site the septic tank and drainfield;
         (b)   Prior to commencing work the applicant shall inform the Building Inspector and the Building Inspector shall inspect the site and count the pilings;
         (c)   The applicant shall remove all glass from the structure, i.e., windows, doors, mirrors and the like;
         (d)   The applicant shall demolish the structure;
         (e)   After removal of the pilings, septic tank and drain lines, and prior to their removal from the site, the applicant shall call for an inspection, and shall receive approval from the Building Inspector prior to continuing work;
         (f)   The applicant shall remove all debris and clean up the site;
         (g)   In an ocean hazard AEC, the applicant shall remove all sand bags, rebuild and stabilize the dune, then call for inspection of the site by the Building Inspector and CAMA official. If the site is found in compliance the Building Inspector shall issue a certificate of compliance; and
         (h)   In an estuarine AEC, the applicant shall call for inspection of the site by the Building Inspector and CAMA official. If the site is found in compliance the Building Inspector shall issue a certificate of compliance.
   (C)   Refusal to issue; appeal to Town Council.
      (1)   If, in the opinion of the Building Inspector, the demolition of any structure or part thereof will cause injury to persons or property, either public or private, or injury to the streets and other public facilities of the town, he or she shall not issue a permit and the structure shall not be demolished.
      (2)   In the event that any permit is refused by the Building Inspector, the owner or contractor may appeal therefrom to the Town Council, and the application shall be considered by the Town Council at a duly convened meeting thereof.
